Data Subject Application Form and Procedure

You may apply to OSDO Arge to exercise the rights listed in Art. 11 of Law No. 6698. Your application must comply with the Communiqué on the Procedures and Principles of Application to the Data Controller. This page explains how to apply and what the form must contain.

1. First: Who Is the Right Recipient?

If you believe your data is processed because you messaged a business’s WhatsApp line, the controller for that data is the business concerned; OSDO Arge acts as processor. You should address your application to that business first. You may also send your request to us; we will pass it on without delay and follow up.

If you are a business user or representative holding a osdosistan account, or you contacted us directly, OSDO Arge is the controller and you may apply to us directly.

2. Mandatory Information

Under Art. 5 of the Communiqué, your application must contain:

• Name, surname and — if the application is in writing — your signature.
• Turkish ID number for Turkish citizens; nationality, passport number or ID number for foreign nationals.
• Your residence or business address for service of notice.
• Your e-mail address, phone and fax number, if any.
• The subject of your request — which right you wish to exercise and over which data.

Any relevant information and documents should be attached. If this information is missing your application may not be processed and you will be asked to complete it.

3. Ways to Apply

Note: applications from an e-mail address not registered in our system may not qualify under the Communiqué, since identity cannot be verified. We will then request additional verification.

4. Applying on Behalf of Another

To apply on behalf of another person, a notarized special power of attorney issued in the applicant’s name is required. Applications made as a parent or guardian must include documents evidencing that capacity.

5. Time Limits and Fees

• Your application is concluded free of charge as soon as possible and within thirty days at the latest.
• Where the process incurs an additional cost, the Board’s tariff may apply: no fee for the first ten pages of a written reply, 1 TRY per page thereafter.
• Where the reply is provided on a recording medium such as a CD or flash drive, a fee not exceeding the cost of that medium may be charged.
• Deletion requests are free of charge in all cases.

6. Identity Verification

We may request additional information to establish that the applicant is the data subject and ask questions to clarify the request. This is to prevent disclosure of your data to unauthorized persons.

7. Right to Complain

Under KVKK Art. 14, if your application is rejected, the reply is found insufficient, or no reply is given in time, you may complain to the Personal Data Protection Board within thirty days of learning the reply and in any case within sixty days of the application date. The application to the controller must be exhausted before complaining to the Board.
